The Supreme Court is supposed to determine constitutionality, not whether or not it’s good policy. That’s the role of Congress, which incidentally already ruled 52-48 against the OSHA mandate in the Senate, indicating it would not pass there.
The court’s three more liberal justices said the mandate was needed. Naturally.
